The Equitable Parent Doctrine was established to grant child custody to an adult, when the adult was not a biological relative of the child.  In situations where the adult considered the child their own and the child considered the adult a parent, equitable parent could be used to argue for that adult to receive custody or visitation rights.  In Missouri, the principle of Equitable Parent is no longer legally recognized as a viable option for non-relatives seeking custody.

 

However, that doesn’t mean that you have no rights as a non-biological relative.  Legal guardianship and adoption without marriage are still two very viable options in some cases.  Establishing and arguing your case for custody or visitation is not an easy task, even if you are a biological parent.  It is much more difficult if you aren’t.  But if you have a strong case, it is possible.
